Terms & Conditions

FXA PLAYER WAIVER & RELEASE FORM

*** You must be 18 years (or older) to participate in any of the sports, events, or anything associated with Fairfax Athletics, a Virginia nonstock corporation ("Fairfax Athletics" or "FXA").

I hereby represent, warrant and attest to the following: (1) that I meet the above participation age requirement; (2) that I am fully cognizant of the risks involved in any/all of the FXA sports and voluntarily assume all of those known and unknown risks; (3) that I agree to abide by the published FXA participation rules at all times during my participation in FXA sports, etc.; and (4) that I do not suffer from any heart, lung or other medical condition or disease that might in any way hinder or prevent me from fully participating in FXA sports or make me more susceptible to injury or harm while playing any of FXA sports.

In consideration of my foregoing representations, and FXAÃ?¢??s approval of my registration application and grant of permission to participate in an FXA sport: (A) I hereby release, discharge and hold harmless FXA and its officers, directors, employees, subsidiaries, agents, successors, managers, volunteers, assigns, and any party named as an additional insured on any policy of insurance held by any of the foregoing parties, or other parties which FXA has or may be obligated to indemnify, hold harmless or to which FXA may otherwise be liable, including but not limited to all governmental or private entities which lease, rent or permit use of premises for play, recreation, pre or post game activities (individually the "Released Party" and collectively, the "Released Parties"), from any and all liability that may arise directly or indirectly at any time, by reason of any injury, death, damage, loss, or expense incurred in connection with (i) my participation in any of the FXA sports, or (ii) my attendance at any social or charitable event or gathering that may be organized, authorized, or paid for by the Released Parties, individual players registered with FXA, or any league or division organized under the Released Parties or their rules, including but not limited to "happy hours", bar functions, and any pre-game or post-game events or gatherings; and (B) I fully authorize FXA, its subsidiaries and affiliates to use my name, likeness or image for purposes of advertising, marketing, promotion or trade without further compensation, except where prohibited by law; and I further acknowledge and agree that any images or recordings obtained or procured by FXA shall be the sole and exclusive property of FXA, and may be published, broadcast or otherwise disseminated at the sole and exclusive discretion of FXA. This Player Release AND Waiver shall be binding on my heirs, executors, administrators, successors, and assigns, and the releases and waivers contained herein shall include damages, losses or injuries that may be caused solely or in part by the fault (including but not limited to negligence, gross negligence and/or recklessness) of the Released Parties. The foregoing indemnification includes all attorney fees and costs incurred by a Released Party in enforcing the indemnification, or defending against claims for damages that are subject to this release and/or indemnification, regardless of whether a lawsuit is filed or who prevails in a lawsuit that is filed.

In simple terms, you will not be able to sue or hold liable Fairfax Athletics and/or its officers, directors, employees, members, subsidiaries, agents, successors, managers, and volunteers for anything! You will play at your own risk!

I HAVE READ AND UNDERSTOOD THIS PLAYER RELEASE WAIVER AND ENTER INTO IT VOLUNTARILY, IN CONSIDERATION OF THE OPPORTUNITY TO PARTICIPATE IN FXA SPORTS.


Code of Conduct Policy

You understand that FXA has a Code of Conduct Policy in place, and your team agrees to comply with the policy: 

As a member of the FXA Sports community, we expect the following from each other:

1.      Respect the Game. We celebrate competition, but we are a recreational league, and fun is the most important thing. Treat the game and the officials with respect at all times.

2.      Respect the Officials. We work hard to recruit the best refs we can; to err is human, right? We may disagree with calls, but we treat referees as fellow humans and show respect and courtesy.

3.      Respect the Opponent. Its just a game! Don't taunt, mock, bait or otherwise put down your opponent. Foul, abusive, or racially-motivated language has no place in our league.

4.      Respect Yourself. Be the teammate you want to have; integrity is an expectation. Treat everyone at the field as you would a friend or colleague -- we share the same goal of sports, fun, and community!


FXA Policies

BY REGISTERING FOR THIS LEAGUE, TOURNAMENT OR EVENT, YOU UNDERSTAND AND AGREE TO ALL OF THE FOLLOWING TERMS, POLICIES AND CONDITIONS.

Player Registration

You understand that all players must register before Week #2 of the season, and that failure to have the minimum # of players on the roster by week 2 (of the league) will result in the forfeiture of all upcoming games until the players are added.  Additionally, all players submitting the player registration the league start date will be charged a $10 late fee up. 

Removing a Player from Roster

You understand that your team must have at least 2 regular season games remaining in order to remove a player from your roster.

Shirt / Jersey Color Policy

You understand that if both teams wear the same shirt color, the Away Team (1st Team listed on Schedule) has to change the shirt color (or a contrasting color pinnie). The alternate jersey must still conform to all relevant jersey requirements.

Required #s on Back of Shirts (Soccer/Basketball)

You understand that all Soccer & Basketball players must have a large (8") permanent number of the back of their shirt.

Only one player per team will be permitted to play without a number. No Exceptions!

Teams must have permanent (no tape) numbers on their jerseys in order to play. Failure to comply will result in a forfeit of that game.

Forfeit Policy

You understand that FXA has a Forfeit Policy in place, and your team agrees to comply with the policy: 

If your team needs to forfeit a game for whatever reason, you must email forfeit@fxasports.com or text us at 703-382-9111 at least 2 hours before your game. A $25 forfeit fine will be added to the team account if your forfeit is received within an hour of game time (or is communicated to us incorrectly). A no-show by your team will result in a $50 fine. A second no-show will result in removal from the league, and you will be ineligible to sign up a team in the future.

All fines must be paid by 12pm the day before your next game to avoid your game being forfeited. 

Sportsmanship Policy

You understand that FXA has a Sportsmanship Policy in place, and you agree to comply with the policy: 

FXA Sports endorses the principles of good sportsmanship, and is committed to fostering a community of respect, tolerance and safety for all participants.  Violations will not be tolerated by FXA Sports.

Unsportsmanlike actions can include the following:

Fighting, pushing or excessively violent fouls

Verbal/physical abuse directed toward an official or opponent,

Profanity or obscene gestures,

Racially, ethnically, gender, or other identity-motivated language, 

Taunting, trash talking, baiting or physically intimidating an official or opponent,

Cheating,

Throwing or abusing equipment

A player may be ejected from a game (or a team may be evicted from the field of play) for engaging in Unsportsmanlike Conduct. An official may call a forfeit for unsportsmanlike conduct at any time, including after the game clock has expired. The League has the authority to suspend and/or expel a player or team from the league and/or future game(s) at its discretion with no refund of monies for such acts. These guidelines apply to players and spectators.

Penalties for Unsportsmanlike Actions:

Any player caught using racially or identity-motivated language will be automatically ejected from that game, and will carry additional suspension at the discretion of the league.

A second offense will result in a one year suspension from all FXA Sports activities

A third offense will result in a permanent ban from All FXA Sports activities

Any player who threatens another individual will be automatically ejected from that game, and will carry additional suspension at the discretion of the league.

A second offense will result in a one year suspension from all FXA Sports activities

A third offense will result in a permanent ban from All FXA Sports activities

Fighting (punching, kicking, or other conduct with the intent to cause injury, whether or not contact is made) will result in an automatic one year suspension from all FXA Sports activities.

A second fighting offense will result in a permanent ban from all FXA Sports activities

Personal Information Policy

The personal information you entered during registration or have on file with FXA is your current home address, and is NOT a work address or false home address.  You understand and agree that using a work or false home address is punishable by league suspension and/or fines imposed by Fairfax County.

Out-of-County Fee Policy

You understand that FXA has an Out-of-County Fee Policy in place, and you agree to comply with the policy: 

If you live outside Fairfax County, you will be required to pay the $30 Out-of-County fee. This fee is not kept by FXA but is paid directly to the county each season. If this fee isn't applied to your registration, it will be added to your account and charged to your credit card on file at a later date.

Division Placement Policy

You understand that FXA has a Division Placement Policy in place, and you agree to comply with the policy: 

Registering your team for a particular division is an indication of preference, not a final decision.   

If your team finishes with a winning record (4-3-1 or equivalent) or better at the end of the season, FXA reserves the right to move your team up to a higher division the following season and/or future seasons (regardless if your team makes the playoffs) in order to keep competition even and the league fair.

If your team finishes with a losing record (3-4-1) or worse at the end of the season, FXA reserves the right to move your team down to a lower division the following season and/or future seasons in order to keep competition even and the league fair.

Weather & Game Reschedule Policy

You understand that FXA has a Weather Policy in place, and you agree to comply with the policy: 

Severe Weather Forecasted

If Fairfax County closes fields, we will know around 3pm each day. If severe weather is in the forecast, we are constantly monitoring the situation throughout the day and into the evening. If we cancel games, all impacted players will receive an email notification as soon as the decision is made.

Weather at the Field

Often, only certain fields may be impacted, or the storms happen quickly near game time. In those situations, the officials at the field have sole discretion on playing, and will advise the league of status.

All FXA leagues adhere to Fairfax County policy regarding severe weather (thunder, lightning) which all players, coaches, managers, and referees are responsible for implementing. It is a requirement that if any individual involved with the League (including non-playing spectators) sees lightning or hears thunder, they must bring it to the referee's attention immediately. EVERYONE shares in this responsibility. When a member of the referee crew sees lightning or hears thunder, or is alerted to such by a player, coach, manager, or spectator, the referee will immediately suspend play for 30 minutes. Everyone MUST clear the field and retreat to the parking lot. Anyone who remains on the field after the referee has ordered everyone off the field acknowledges that they do so at their own risk and that neither the League nor the referee crew assigned to the match can be held responsible or any injuries occurring as long as play is suspended.

At no time may an individual ask the referee to ignore the lightning or thunder or insist that play be allowed to continue. The referee will wait 30 minutes from the last flash of lightning or peal of thunder. Each time lightning re-appears or thunder is heard, the referee MUST restart the 30 minute clock. 

For certain sports, actual game time may be shortened to allow the game to play to completion on the impacted night.

Reschedules

If a game isn't played due to weather, it will be rescheduled for later in the season. First priority will be on the same league night, but may be on a different night of the week due to season and field limitations. 

In extreme circumstances, FXA Sports does reserve the right to run a shortened season without a refund. We will make every attempt to get all regular season games played, however for every two (2) game cancellations due to weather, the season may be shortened one (1) regular season game.

Jewelry, Electronics & Supportive Device Policy

You understand that FXA has a Jewelry, Electronics & Supportive Device Policy in place, and you agree to comply with the policy: 

For any FXA Sports game, players must remove all exposed facial jewelry, watches, cameras (GoPros, cell phones),  activity trackers (Fitbits, Apple Watch, etc.) and other wrist jewelry.  Medical ID bracelets may be worn at any time.

Braces/Casts: A guard, cast or brace made of a hard or unyielding substance (such as plastic, plaster or metal) must not be worn on the elbow, hand, wrist or forearm, even if covered by padding.

Knee and ankle braces are permitted and do not require any padding.

All jewelry and supportive equipment decisions are at the referee's sole discretion.

Facility/Field Use Policy

You understand that FXA has a Facility/Field Use Policy in place, and you agree to comply with the policy:

Please stay off the field until the prior user group is done.

No Alcohol or Drugs are allowed on or near the field

There is NO Smoking on or around turf fields

Pets are not allowed on Turf Fields or on School grounds

Failure to comply with these rules could result in a forfeit match and/or league suspension.

Holiday Policy

You understand that FXA has a Holiday Policy in place, and you agree to comply with the policy: 

Holiday celebrations are important! Here are the days when you can expect no league games:

Super Bowl Sunday (no games after 5pm)

Easter Sunday

Mother's Day

Memorial Day Weekend (Sat-Mon)

Independence Day

Labor Day Weekend (Sat-Mon)

Thanksgiving Weekend (Thurs-Sun)

Christmas Eve through New Year's Day

Please expect that all other holidays that fall on your league day will have games scheduled, and we will not be able to accommodate bye week or reschedule requests for those days.


Refund Policy

You understand that FXA has a Refund Policy in place, and you agree to comply with the policy: 

All registration fees are non-refundable. Registering for a team is a commitment to participate in the full season.

In some cases, we may need to delay the start of the league. This may be due to teams needing more time to complete their rosters, playing facilities having schedule conflicts and myriad other reasons. We reserve the right to delay league starts, and will incorporate all planned games into the revised schedule to the best of our ability. Delayed season starts are not grounds for a refund.

Players or teams' decision not to participate in a league they have registered for is not grounds for a refund. If players or teams choose not to participate after they have registered and before the season starts, they may request a credit to use towards a future league. All requests must be submitted in writing to refund@fxasports.com.

In the case of excessive cancelled games due to weather, or any other circumstances causing a reduction in the number of games played, there will be no refund or credit for games not played. FXA Sports reserves the right to host games on days other than a normal day of regular season play, and at alternate times and locations from those originally designated if necessary. No refunds shall be provided under these circumstances. Should a league be cancelled entirely, players always have the option to transfer to another league, or hold a credit to be used for a future season.

Refunds will only be processed at the discretion of FXA Sports, and will only occur if an individual league or activity has been cancelled due to an insufficient number of teams registered, and no alternate leagues for that sport are available. Changes in location, start or end dates, season or duration are not grounds for requesting a refund. All refunds must be requested in writing to refund@fxasports.com, and be received prior to the originally posted registration close date for that league.

All social event tickets are non-refundable.

IN WITNESS WHEREOF, Participant has read and voluntarily e-signed this Release, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.


Financial Responsibility Agreement

I understand that as the team captain, any outstanding balance owed 5 days after registration closes (either by myself or my team) will become my responsibility to pay. My card on file will be charged any outstanding amount, and that my team will forfeit any game after that point when there is an outstanding balance.
